1. Is probate required in Florida?

When a person passes away in Florida, probate is required in most cases. The only case in which it’s not needed is when the asset base is in a living trust or is transferred to the listed beneficiaries. Properties need to go through probate if the decedent is the sole owner or if the co-owner doesn’t have the legal right to transfer them.

2. How long does probate take?

3. Does a will have to be probated?

4. How long do you have to file probate after death?

One of the first steps to take is to file the will with the county court. It must be filed no more than ten days after a person’s death. In case probate is needed, the will still needs to be validated by the court to determine how the assets and properties are to be distributed.
